Required Elements for DMCA Notice

Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material

A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner

3 How to File a Copyright Complaint

Filing Process

To file a copyright infringement notice, please send a written communication that includes all required DMCA elements to our designated copyright agent.

Step 3: Send the notice to our designated copyright agent

Step 4: We will review and respond within the legal timeframe

4 Counter-Notification Process

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us.

Counter-Notification Requirements

• Your physical or electronic signature
• Identification of the material that has been removed or disabled
• A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake
• Your name, address, and telephone number
• A statement that you consent to the jurisdiction of Federal District Court
• A statement that you will accept service of process from the complaining party

What Happens Next

Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If the complaining party does not file a court action within 10 business days, we may restore the removed content.

5 Repeat Infringer Policy

It is Rally Foundation's policy, in appropriate circumstances, to terminate accounts of account holders who are repeat infringers.

We may terminate a user's access to the Rally platform if they are subject to repeated DMCA takedown notices or are otherwise determined to be willfully infringing copyrights.

Factors we consider include:

  • • Number of DMCA notices received
  • • Whether the user filed counter-notifications
  • • Whether the content was restored after counter-notification
  • • The user's response to infringement claims
